Terms of Service

The binding covenant between you and Mortek, operator of Shadowrealm: Age of Darkness. These Terms govern your right to walk these lands. Read them with the same care you would bring to a contract signed in shadow ink.

Acceptance

By registering an account or using Shadowrealm: Age of Darkness in any capacity, you declare that you have read, understood, and accept these Terms of Service in full. If you do not accept these Terms, you may not register, access, or use the game in any form.

These Terms constitute a binding legal agreement between you ("the Player") and Mortek, operated by Maurice Moret, based in the Netherlands ("Mortek", "we", "us"). They are to be read alongside our Payment Policies and Privacy Policy, which are incorporated herein by reference.

Eligibility

The gates of Shadowrealm are open only to those who have reached the age of eighteen. By creating an account you affirm that you are at least 18 years of age. If we discover that an account belongs to a minor, it will be closed without warning or appeal.

Your Account

You are solely responsible for all activity that occurs under your account, whether or not you personally authorised it. The keepers do not distinguish between a breach committed by you and one committed by someone who gained access to your credentials through your negligence.

Virtual Currency & Goods

Shadowgems are virtual currency that may be acquired through real-money purchase within the game. All virtual currency and virtual goods within Shadowrealm — Shadowgems, in-game gold, items, equipment, titles, cosmetics, and any other digital asset — are owned exclusively by Mortek.

Purchases

Real-money transactions within Shadowrealm are governed by our Payment Policies, which you must read and accept before making any purchase. All purchases are subject to those terms, including provisions regarding refunds, chargebacks, and failed transactions.

By completing a purchase, you confirm that you are the authorised holder of the payment method used, and that you have the legal right to make the transaction. Fraudulent purchases will result in immediate account termination and, where applicable, referral to relevant authorities.

Prohibited Conduct

In addition to conduct prohibited by our Rules of Conduct, the following are forbidden under these Terms and may result in account termination, legal action, or both:

Intellectual Property

All content within Shadowrealm: Age of Darkness — including but not limited to its source code, visual art, written text, music, sound design, character designs, world design, lore, and all other creative and technical works — is the exclusive intellectual property of Mortek and is protected by applicable copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, transmit, publish, display, perform, modify, adapt, translate, or create derivative works based upon any part of the game's content without the express prior written permission of Mortek. Unauthorised use is a breach of these Terms and may expose you to legal liability.

Your in-game name, character name, and any original creative text you submit through guild messages, forum posts, or in-game communication remain yours. By submitting such content you grant Mortek a worldwide, royalty-free, non-exclusive licence to display and transmit that content to other users of the game as part of normal game operation.

Disclaimers

Shadowrealm: Age of Darkness is provided "as is" and "as available", without warranties of any kind — express, implied, or statutory. To the fullest extent permitted by law, Mortek disclaims all warranties including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that the game will be available at all times, that access will be uninterrupted or error-free, that defects will be corrected, or that the servers are free of harmful components. The realm exists at our pleasure, and we reserve the right to modify, suspend, or discontinue it at any time with or without notice.

Limitation of Liability

To the fullest extent permitted by applicable law, Mortek's total cumulative liability to you for any claim arising out of or relating to these Terms or the game shall not exceed the total amount you paid to Mortek in the twelve months immediately preceding the event giving rise to the claim.

Under no circumstances shall Mortek be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, loss of virtual goods, or the cost of procuring substitute services — even if Mortek has been advised of the possibility of such damages.

Some jurisdictions do not permit the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the limitations above apply only to the extent permitted by law.

Governing Law

These Terms and any dispute arising out of or in connection with them — including disputes regarding their existence, validity, or termination — shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict-of-law provisions.

You irrevocably submit to the exclusive jurisdiction of the competent courts of the Netherlands to resolve any dispute arising out of or in connection with these Terms or your use of Shadowrealm. If you are a consumer in another jurisdiction, you retain any mandatory rights afforded to you by the laws of that jurisdiction that cannot be waived by contract.

Changes to These Terms

The realm and its laws are not static. We may revise these Terms at any time. Where a change is material — that is, where it meaningfully affects your rights or obligations — we will announce it within the game with reasonable notice before the change takes effect.

The revised Terms will always be available at this page. Your continued use of Shadowrealm after any change has taken effect constitutes your acceptance of the Terms as they then stand. If you do not accept a revised version, your remedy is to cease using the game.
